Terms and Conditions

§1

Preliminary Provisions

The online store Manufaktura Książek, available at https://manufaktura-ksiazek.salescrm.pl, is operated by Manufaktura Książek sp. z o.o., ul. Arakowa 61, 05-500 Zamienie, NIP 1231546248, REGON 527206660, KRS 0001075850.

These Terms and Conditions apply to both Consumers and Business Customers using the Store and define the rules for using the online store as well as the terms and procedure for concluding distance sales agreements with Customers via the Store.

 

§2

Definitions

Consumer – a natural person concluding an agreement with the Seller within the Store, where the subject of the agreement is not directly related to their business or professional activity.

Seller – Manufaktura Książek sp. z o.o., ul. Arakowa 61, 05-500 Zamienie, NIP 1231546248, REGON 527206660, KRS 0001075850.

Customer – any entity placing an order via the Store.

Business Customer – a natural person, legal person, or organisational unit without legal personality, to which a separate act grants legal capacity, conducting business activity in their own name, using the Store.

Store – the online store operated by the Seller at https://manufaktura-ksiazek.salescrm.pl.

Distance Agreement – an agreement concluded with the Customer within an organised distance contracting system (within the Store), without the simultaneous physical presence of the parties, using only one or more means of distance communication.

Terms and Conditions – these store regulations.

Order – the Customer’s declaration of intent submitted via the Order Form, aimed directly at concluding a Sales Agreement for the Product(s) with the Seller.

Account – the Customer’s account in the Store, containing the data provided by the Customer and information on their Orders.

Registration Form – a form available in the Store that allows for the creation of an Account.

Order Form – an interactive form available in the Store allowing for order placement, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including delivery and payment methods.

Basket – a software component of the Store, in which the Products selected by the Customer are visible, and where order data can be established and modified, particularly product quantities.

Product – a movable item or service available in the Store, which is the subject of a Sales Agreement between the Customer and the Seller.

Sales Agreement – a contract for the sale of a Product concluded between the Customer and the Seller via the online Store. Depending on the characteristics of the Product, the Sales Agreement also includes service contracts and contracts for specific work.

§4

Technical Requirements

To use the Store, browse the assortment, and place orders for Products, the following are required:

  • an end device with Internet access and an up-to-date web browser (Firefox v.3+, Opera v.9+, Chrome v.10+, Safari),

  • an active email account,

  • cookies enabled.

 

§5

General Information

To the fullest extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the operation of the Store caused by force majeure, unauthorised actions of third parties, or incompatibility of the Store with the Customer’s technical infrastructure.

Browsing the Store’s assortment does not require an Account. Placing orders for Products in the Store is possible by providing necessary personal and address data enabling the fulfilment of the Order.

Prices shown in the Store are in Polish zloty (PLN) and include VAT (gross prices).

The final (total) amount payable by the Customer includes the price of the Product and delivery costs (including charges for transport, delivery, and postal services), about which the Customer is informed on the Store’s pages during the Order placement process, including when expressing the intention to conclude a Sales Agreement.

In the case of subscriptions or services provided for an indefinite period, the final price includes all payments for the settlement period.

If the nature of the subject of the Agreement does not allow for the prior reasonable calculation of the final price, information on how the price will be calculated, as well as transport, delivery, postal charges, and other costs, will be provided in the Product description in the Store.

 

§6

Order Placement Procedure

To place an Order:

  • select a Product to be ordered, then click “Add to Basket” (or equivalent);

  • fill in the Order Form by entering recipient and delivery address data, selecting the type of delivery, and providing invoice details if different from the recipient;

  • click the “Order and Pay” button (or equivalent);

  • choose one of the available payment methods and complete the payment.

 

§7

Delivery and Payment Methods

Delivery methods available to the Customer:
a. Courier delivery Kurier48 (Poczta Polska) – delivery within 2 business days from dispatch,
b. ORLEN Paczka – delivery within 4 business days from dispatch,
c. InPost Parcel Locker – delivery within 3 business days from dispatch,
d. DPD Courier – delivery within 2 business days from dispatch,
e. FedEx Courier – delivery within 2 business days from dispatch.

Payment methods via TPay:
a. Electronic payment (bank transfers and BLIK),
b. Card payment: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.

Online payments for card transactions are processed by TPay.

§8

Sales Agreement Fulfilment

The Sales Agreement between the Customer and Seller is concluded after the Customer places an Order via the Order Form, in accordance with §6.

After placing an Order, the Seller immediately confirms its receipt and accepts the Order for processing. Confirmation and acceptance are sent via email to the address provided during order placement. The message includes the Seller’s confirmation of receipt and acceptance of the Order and confirmation of the Sales Agreement.

At that moment, the Sales Agreement between the Customer and the Seller is concluded.

For electronic or card payments, the Customer must pay within 2 calendar days from the conclusion of the Sales Agreement, otherwise the order will be cancelled.

The Product will be dispatched within the period specified in its description, by the delivery method chosen by the Customer during the Order process.

For Orders containing Products with different delivery times, the delivery time is the longest of them.

The delivery period begins from the date the Seller’s bank account is credited, or for card payments, from the date of positive payment authorisation.

Delivery is available within Poland only.

 

§9

Right of Withdrawal

The Consumer has the right to withdraw from the Sales Agreement within 14 days without providing any reason.

The withdrawal period begins:

  • from the delivery of the Product to the Consumer or a third party other than the carrier designated by the Consumer;

  • for multiple Products delivered separately or in parts – from the delivery of the last item;

  • for regular deliveries – from receipt of the first item.

To exercise the right of withdrawal, the Consumer must submit a withdrawal notice to the Seller before the withdrawal period expires.

The notice may be sent by post or electronically to the email address provided in §3. A template form (not mandatory) is provided in the Polish Consumer Rights Act of 30 May 2014.

If sent electronically, the Seller will confirm receipt by email.

Consequences of withdrawal:
a. The agreement is considered void.
b. The Seller shall refund all payments, including delivery costs (except for additional costs resulting from delivery methods other than the least expensive standard option) within 14 days of receiving the withdrawal notice.
c. Refunds are made using the same payment method unless otherwise agreed with the Consumer. For card payments, the refund is made to the bank account linked to the card.
d. The Seller may withhold the refund until the Product is returned or proof of return is provided.
e. The Product must be returned to: IMKER Logistyka, Żurawnica 82, 22-470 Zwierzyniec within 14 days.
f. The Consumer bears the direct cost of returning the Product, including additional costs due to the Product’s nature.
g. The Consumer is liable for any diminished value resulting from handling beyond what is necessary to determine the nature and characteristics of the Product.

The right of withdrawal does not apply to agreements:
a. for sealed Products which cannot be returned for health or hygiene reasons once opened;
b. for services fully performed with the Consumer’s consent and prior acknowledgement of waiver of withdrawal rights;
c. for items inseparably mixed with others after delivery;
d. for digital content not on a tangible medium, if delivery has begun with the Consumer’s consent and acknowledgement of lost withdrawal rights.

 

§10

Complaints and Warranty

The Sales Agreement covers new Products.
If a purchased Product has a defect, the Customer may file a complaint under the provisions of the Civil Code regarding warranty.

Complaints can be submitted in writing or electronically using the Seller’s contact details in these Terms and Conditions.

The complaint should include: a description of the defect, circumstances of its occurrence, Customer’s details, and the requested outcome.

The Seller will respond within 14 days. If no response is given, the complaint is considered accepted.

Products under complaint should be returned to: IMKER, ul. Szczebrzeska 55a, 22-400 Zamość.

 

§11

Out-of-Court Complaint Handling and Redress

Details regarding out-of-court complaint procedures and redress are available at local Consumer Ombudsman offices, consumer protection organisations, Trade Inspection offices, and online at:

Consumers may:
a. apply to a permanent consumer arbitration court under Article 37 of the Act on Trade Inspection (Journal of Laws 2014, item 148);
b. request mediation at a voivodeship Trade Inspection office under Article 36 of the same Act;
c. obtain free legal aid from a local Consumer Ombudsman or a consumer protection NGO (e.g., Consumer Federation, Polish Consumers Association).

§12

Personal Data in the Online Store

The Seller is the administrator of personal data collected via the Store.

Personal data is processed to fulfil the Sales Agreement and, if consent is given via a checkbox in the basket, for marketing purposes.

Recipients of Customer data may include:
a. couriers or postal services for delivery;
b. online payment processors for electronic and card payments.

Customers have the right to access and correct their data.

Providing personal data is voluntary but necessary to conclude the Sales Agreement.

§13

Final Provisions

Agreements concluded via the Store are in Polish.

The Seller reserves the right to amend the Terms and Conditions for valid reasons (e.g. legal changes, delivery/payment method updates). Customers will be informed at least 7 days in advance.

In matters not covered, Polish law applies, in particular the Civil Code, the Act on Electronic Services, the Consumer Rights Act, and the Personal Data Protection Act.
