Arakowa 61, 05-500 Zamienie, NIP 1231546248, REGON 527206660, KRS 0001075850.<\/span><\/p><p><span style=\"color: #000000;\">These Terms and Conditions apply to both Consumers and Business Customers using the Store and define the rules for using the online store as well as the terms and procedure for concluding distance sales agreements with Customers via the Store.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a72<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Definitions<\/span><\/strong><\/p><p><span style=\"color: #000000;\">Consumer \u2013 a natural person concluding an agreement with the Seller within the Store, where the subject of the agreement is not directly related to their business or professional activity.<\/span><\/p><p><span style=\"color: #000000;\">Seller \u2013 Manufaktura Ksi\u0105\u017cek sp. z o.o., ul. Arakowa 61, 05-500 Zamienie, NIP 1231546248, REGON 527206660, KRS 0001075850.<\/span><\/p><p><span style=\"color: #000000;\">Customer \u2013 any entity placing an order via the Store.<\/span><\/p><p><span style=\"color: #000000;\">Business Customer \u2013 a natural person, legal person, or organisational unit without legal personality, to which a separate act grants legal capacity, conducting business activity in their own name, using the Store.<\/span><\/p><p><span style=\"color: #000000;\">Store \u2013 the online store operated by the Seller at <a style=\"color: #000000;\" href=\"https:\/\/manufaktura-ksiazek.salescrm.pl\/\">https:\/\/manufaktura-ksiazek.salescrm.pl<\/a>.<\/span><\/p><p><span style=\"color: #000000;\">Distance Agreement \u2013 an agreement concluded with the Customer within an organised distance contracting system (within the Store), without the simultaneous physical presence of the parties, using only one or more means of distance communication.<\/span><\/p><p><span style=\"color: #000000;\">Terms and Conditions \u2013 these store regulations.<\/span><\/p><p><span style=\"color: #000000;\">Order \u2013 the Customer\u2019s declaration of intent submitted via the Order Form, aimed directly at concluding a Sales Agreement for the Product(s) with the Seller.<\/span><\/p><p><span style=\"color: #000000;\">Account \u2013 the Customer\u2019s account in the Store, containing the data provided by the Customer and information on their Orders.<\/span><\/p><p><span style=\"color: #000000;\">Registration Form \u2013 a form available in the Store that allows for the creation of an Account.<\/span><\/p><p><span style=\"color: #000000;\">Order Form \u2013 an interactive form available in the Store allowing for order placement, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including delivery and payment methods.<\/span><\/p><p><span style=\"color: #000000;\">Basket \u2013 a software component of the Store, in which the Products selected by the Customer are visible, and where order data can be established and modified, particularly product quantities.<\/span><\/p><p><span style=\"color: #000000;\">Product \u2013 a movable item or service available in the Store, which is the subject of a Sales Agreement between the Customer and the Seller.<\/span><\/p><p><span style=\"color: #000000;\">Sales Agreement \u2013 a contract for the sale of a Product concluded between the Customer and the Seller via the online Store. Depending on the characteristics of the Product, the Sales Agreement also includes service contracts and contracts for specific work.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a73<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Contacting the Store<\/span><\/strong><\/p><p><span style=\"color: #000000;\">Seller&#8217;s email address: <a style=\"color: #000000;\" href=\"mailto:sklep@manufakturaksiazek.pl\">sklep@manufakturaksiazek.pl<\/a><\/span><br \/><span style=\"color: #000000;\">Customers may contact the Seller via the email address provided above.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a74<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Technical Requirements<\/span><\/strong><\/p><p><span style=\"color: #000000;\">To use the Store, browse the assortment, and place orders for Products, the following are required:<\/span><\/p><ul><li><p><span style=\"color: #000000;\">an end device with Internet access and an up-to-date web browser (Firefox v.3+, Opera v.9+, Chrome v.10+, Safari),<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">an active email account,<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">cookies enabled.<\/span><\/p><\/li><\/ul><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a75<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">General Information<\/span><\/strong><\/p><p><span style=\"color: #000000;\">To the fullest extent permitted by law, the Seller shall not be liable for disruptions, including interruptions in the operation of the Store caused by force majeure, unauthorised actions of third parties, or incompatibility of the Store with the Customer&#8217;s technical infrastructure.<\/span><\/p><p><span style=\"color: #000000;\">Browsing the Store&#8217;s assortment does not require an Account. Placing orders for Products in the Store is possible by providing necessary personal and address data enabling the fulfilment of the Order.<\/span><\/p><p><span style=\"color: #000000;\">Prices shown in the Store are in Polish zloty (PLN) and include VAT (gross prices).<\/span><\/p><p><span style=\"color: #000000;\">The final (total) amount payable by the Customer includes the price of the Product and delivery costs (including charges for transport, delivery, and postal services), about which the Customer is informed on the Store&#8217;s pages during the Order placement process, including when expressing the intention to conclude a Sales Agreement.<\/span><\/p><p><span style=\"color: #000000;\">In the case of subscriptions or services provided for an indefinite period, the final price includes all payments for the settlement period.<\/span><\/p><p><span style=\"color: #000000;\">If the nature of the subject of the Agreement does not allow for the prior reasonable calculation of the final price, information on how the price will be calculated, as well as transport, delivery, postal charges, and other costs, will be provided in the Product description in the Store.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a76<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Order Placement Procedure<\/span><\/strong><\/p><p><span style=\"color: #000000;\">To place an Order:<\/span><\/p><ul><li><p><span style=\"color: #000000;\">select a Product to be ordered, then click &#8222;Add to Basket&#8221; (or equivalent);<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">fill in the Order Form by entering recipient and delivery address data, selecting the type of delivery, and providing invoice details if different from the recipient;<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">click the &#8222;Order and Pay&#8221; button (or equivalent);<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">choose one of the available payment methods and complete the payment.<\/span><\/p><\/li><\/ul><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a77<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Delivery and Payment Methods<\/span><\/strong><\/p><p><span style=\"color: #000000;\">Delivery methods available to the Customer:<\/span><br \/><span style=\"color: #000000;\">a. Courier delivery Kurier48 (Poczta Polska) \u2013 delivery within 2 business days from dispatch,<\/span><br \/><span style=\"color: #000000;\">b. ORLEN Paczka \u2013 delivery within 4 business days from dispatch,<\/span><br \/><span style=\"color: #000000;\">c. InPost Parcel Locker \u2013 delivery within 3 business days from dispatch,<\/span><br \/><span style=\"color: #000000;\">d. DPD Courier \u2013 delivery within 2 business days from dispatch,<\/span><br \/><span style=\"color: #000000;\">e. FedEx Courier \u2013 delivery within 2 business days from dispatch.<\/span><\/p><p><span style=\"color: #000000;\">Payment methods via TPay:<\/span><br \/><span style=\"color: #000000;\">a. Electronic payment (bank transfers and BLIK),<\/span><br \/><span style=\"color: #000000;\">b. Card payment: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.<\/span><\/p><p><span style=\"color: #000000;\">Online payments for card transactions are processed by TPay.<\/span><\/p><p><span style=\"color: #000000;\">Detailed delivery and payment information is available on the Store website.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a78<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Sales Agreement Fulfilment<\/span><\/strong><\/p><p><span style=\"color: #000000;\">The Sales Agreement between the Customer and Seller is concluded after the Customer places an Order via the Order Form, in accordance with \u00a76.<\/span><\/p><p><span style=\"color: #000000;\">After placing an Order, the Seller immediately confirms its receipt and accepts the Order for processing. Confirmation and acceptance are sent via email to the address provided during order placement. The message includes the Seller\u2019s confirmation of receipt and acceptance of the Order and confirmation of the Sales Agreement.<\/span><\/p><p><span style=\"color: #000000;\">At that moment, the Sales Agreement between the Customer and the Seller is concluded.<\/span><\/p><p><span style=\"color: #000000;\">For electronic or card payments, the Customer must pay within 2 calendar days from the conclusion of the Sales Agreement, otherwise the order will be cancelled.<\/span><\/p><p><span style=\"color: #000000;\">The Product will be dispatched within the period specified in its description, by the delivery method chosen by the Customer during the Order process.<\/span><\/p><p><span style=\"color: #000000;\">For Orders containing Products with different delivery times, the delivery time is the longest of them.<\/span><\/p><p><span style=\"color: #000000;\">The delivery period begins from the date the Seller\u2019s bank account is credited, or for card payments, from the date of positive payment authorisation.<\/span><\/p><p><span style=\"color: #000000;\">Delivery is available within Poland only.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a79<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Right of Withdrawal<\/span><\/strong><\/p><p><span style=\"color: #000000;\">The Consumer has the right to withdraw from the Sales Agreement within 14 days without providing any reason.<\/span><\/p><p><span style=\"color: #000000;\">The withdrawal period begins:<\/span><\/p><ul><li><p><span style=\"color: #000000;\">from the delivery of the Product to the Consumer or a third party other than the carrier designated by the Consumer;<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">for multiple Products delivered separately or in parts \u2013 from the delivery of the last item;<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">for regular deliveries \u2013 from receipt of the first item.<\/span><\/p><\/li><\/ul><p><span style=\"color: #000000;\">To exercise the right of withdrawal, the Consumer must submit a withdrawal notice to the Seller before the withdrawal period expires.<\/span><\/p><p><span style=\"color: #000000;\">The notice may be sent by post or electronically to the email address provided in \u00a73. A template form (not mandatory) is provided in the Polish Consumer Rights Act of 30 May 2014.<\/span><\/p><p><span style=\"color: #000000;\">If sent electronically, the Seller will confirm receipt by email.<\/span><\/p><p><span style=\"color: #000000;\">Consequences of withdrawal:<\/span><br \/><span style=\"color: #000000;\">a. The agreement is considered void.<\/span><br \/><span style=\"color: #000000;\">b. The Seller shall refund all payments, including delivery costs (except for additional costs resulting from delivery methods other than the least expensive standard option) within 14 days of receiving the withdrawal notice.<\/span><br \/><span style=\"color: #000000;\">c. Refunds are made using the same payment method unless otherwise agreed with the Consumer. For card payments, the refund is made to the bank account linked to the card.<\/span><br \/><span style=\"color: #000000;\">d. The Seller may withhold the refund until the Product is returned or proof of return is provided.<\/span><br \/><span style=\"color: #000000;\">e. The Product must be returned to: IMKER Logistyka, \u017burawnica 82, 22-470 Zwierzyniec within 14 days.<\/span><br \/><span style=\"color: #000000;\">f. The Consumer bears the direct cost of returning the Product, including additional costs due to the Product\u2019s nature.<\/span><br \/><span style=\"color: #000000;\">g. The Consumer is liable for any diminished value resulting from handling beyond what is necessary to determine the nature and characteristics of the Product.<\/span><\/p><p><span style=\"color: #000000;\">The right of withdrawal does not apply to agreements:<\/span><br \/><span style=\"color: #000000;\">a. for sealed Products which cannot be returned for health or hygiene reasons once opened;<\/span><br \/><span style=\"color: #000000;\">b. for services fully performed with the Consumer\u2019s consent and prior acknowledgement of waiver of withdrawal rights;<\/span><br \/><span style=\"color: #000000;\">c. for items inseparably mixed with others after delivery;<\/span><br \/><span style=\"color: #000000;\">d. for digital content not on a tangible medium, if delivery has begun with the Consumer\u2019s consent and acknowledgement of lost withdrawal rights.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a710<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Complaints and Warranty<\/span><\/strong><\/p><p><span style=\"color: #000000;\">The Sales Agreement covers new Products.<\/span><br \/><span style=\"color: #000000;\">If a purchased Product has a defect, the Customer may file a complaint under the provisions of the Civil Code regarding warranty.<\/span><\/p><p><span style=\"color: #000000;\">Complaints can be submitted in writing or electronically using the Seller\u2019s contact details in these Terms and Conditions.<\/span><\/p><p><span style=\"color: #000000;\">The complaint should include: a description of the defect, circumstances of its occurrence, Customer\u2019s details, and the requested outcome.<\/span><\/p><p><span style=\"color: #000000;\">The Seller will respond within 14 days. If no response is given, the complaint is considered accepted.<\/span><\/p><p><span style=\"color: #000000;\">Products under complaint should be returned to: IMKER, ul. Szczebrzeska 55a, 22-400 Zamo\u015b\u0107.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a711<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Out-of-Court Complaint Handling and Redress<\/span><\/strong><\/p><p><span style=\"color: #000000;\">Details regarding out-of-court complaint procedures and redress are available at local Consumer Ombudsman offices, consumer protection organisations, Trade Inspection offices, and online at:<\/span><\/p><ul><li><p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php\">http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php<\/a><\/span><\/p><\/li><li><p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"http:\/\/www.uokik.gov.pl\/sprawy_indywidualne.php\">http:\/\/www.uokik.gov.pl\/sprawy_indywidualne.php<\/a><\/span><\/p><\/li><li><p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"http:\/\/www.uokik.gov.pl\/wazne_adresy.php\">http:\/\/www.uokik.gov.pl\/wazne_adresy.php<\/a><\/span><\/p><\/li><\/ul><p><span style=\"color: #000000;\">Consumers may:<\/span><br \/><span style=\"color: #000000;\">a. apply to a permanent consumer arbitration court under Article 37 of the Act on Trade Inspection (Journal of Laws 2014, item 148);<\/span><br \/><span style=\"color: #000000;\">b. request mediation at a voivodeship Trade Inspection office under Article 36 of the same Act;<\/span><br \/><span style=\"color: #000000;\">c. obtain free legal aid from a local Consumer Ombudsman or a consumer protection NGO (e.g., Consumer Federation, Polish Consumers Association).<\/span><\/p><p><span style=\"color: #000000;\">\u00a712<\/span><\/p><p><span style=\"color: #000000;\">Personal Data in the Online Store<\/span><\/p><p><span style=\"color: #000000;\">The Seller is the administrator of personal data collected via the Store.<\/span><\/p><p><span style=\"color: #000000;\">Personal data is processed to fulfil the Sales Agreement and, if consent is given via a checkbox in the basket, for marketing purposes.<\/span><\/p><p><span style=\"color: #000000;\">Recipients of Customer data may include:<\/span><br \/><span style=\"color: #000000;\">a. couriers or postal services for delivery;<\/span><br \/><span style=\"color: #000000;\">b. online payment processors for electronic and card payments.<\/span><\/p><p><span style=\"color: #000000;\">Customers have the right to access and correct their data.<\/span><\/p><p><span style=\"color: #000000;\">Providing personal data is voluntary but necessary to conclude the Sales Agreement.<\/span><\/p><p><span style=\"color: #000000;\">Full details are available in the Store\u2019s Privacy Policy.<\/span><\/p><p>\u00a0<\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">\u00a713<\/span><\/strong><\/p><p style=\"text-align: center;\"><strong><span style=\"color: #000000;\">Final Provisions<\/span><\/strong><\/p><p><span style=\"color: #000000;\">Agreements concluded via the Store are in Polish.<\/span><\/p><p><span style=\"color: #000000;\">The Seller reserves the right to amend the Terms and Conditions for valid reasons (e.g. legal changes, delivery\/payment method updates).
